Rental, Subscriber, Contracts, Linkt Terms The Rental Contract comprises this rental document for the hire of the Vehicle(“Renta lAgreement”)and the terms and conditions of rental (“Terms and Conditions”). The Subscriber Contract comprises the documents and the Car Rentals Near Me Terms and Conditions. The Linkt Terms and Conditions include an obligation on You to pay Toll aust Pty Limited (ACN050538693) trading as Linkt (“Linkt”) a Service Fee of $3.30 (incl GST) for each calendar day on which You use a toll road in addition to payment to Linkt of the Applicable Tolls. Important Terms That May Effect Your Liability 1. If there is Damage (however caused), theft of the Vehicle or Third Party Loss You must pay up to the Damage Excess shown in this Rental Agreement plus GST. Damage Cover Products may be purchased to reduce Your liability. We will be taking sighting card details upon vehicle pickup. Damage means: (a) any loss or damage to the Vehicle however caused that is reported to Us, detected at the post rental inspection or at the Final Inspection; requires repair or replacement, and is not Fair Wear and Tear. (b) towing, recovery and salvage fees; (c) assessing fees; and (d) Loss of Use, and for the removal of doubt, damage to the Vehicle’s windscreen, lights, wheels or tyres that makes the Vehicle unroadworthy is not Fair Wear and Tear. 2. Cover for Damage or Third Party Loss is excluded in some circumstances even if You purchase Damage Cover Products. These exclusions are fully set out in the Terms and Conditions. They include Damage or Third Party Loss caused by use of the Vehicle in a prohibited area, Overhead Damage, including over head contact to any part of the Pantech or box section of a Commercial Vehicle, Underbody Damage, inundation or immersion of the Vehicle in water and use of the incorrect fuel type. Driving the Vehicle above the Snow Line is never permitted unless You purchase Snow Cover at the Start of Rental. Driving on Unsealed Roads is only permitted if the road is well maintained, is no more than 500metres in length and Your speed does not exceed 40kph. Off Road use is always strictly prohibited. 3. If You return the Vehicle earlier than the date and time shown in the Rental Agreement We will not refund any unused daily Rental Charges to You unless You provide a reasonable explanation in which case We may allow a refund to be made but the daily rate will be adjusted for the actual days used. You will also be charged for extra kilometres if You exceed the free kilometres applicable to Your Rental Period and Vehicle class. A charge for each kilometre driven in excess of the kilometre allowance noted on the Hire Particulars, averaged over the duration of the Hire Period (and any other period in which You have possession, custody or control of the Rented Vehicle), and charged at the kilometre rate noted on the Hire Particulars of this page. This applies to all contracts regardless of the excess, even if noted unlimited. 4. Before returning the Vehicle it is Your responsibility to delete any Personal Information or data, such as mobile phone numbers, stored addresses, or navigation history, that may have been used during the Rental Period. 5. If the Vehicle is returned more than 30minutes after the return time set in this Rental Agreement You will be charged one full day’s extra rental and a full day’s rental for each subsequent 24 hour period until the Vehicle is returned to Us. 6. Parking, speeding and traffic infringements are Your responsibility and unless Roadside Assistance Cover has been purchased, fees ranging from $100 to $2,000 apply to driver induced errors, such as a flat battery, lost keys and wheel changing, tyre repair or replacement. An administrative fee of $55 applies in all of these cases. 7. If You are involved in an Accident or the Vehicle is stolen, You must immediately report the Accident or theft to Us and fully complete an Incident Report Form within 4 days. You must also fully co-operate with Us in the investigation of the Accident or theft and in any subsequent court proceedings. If you are deemed to be at fault an excess fee of $5,000 + GST is payable 8. You authorise Us and Linkt to charge all amounts payable under Your Rental Contract and the Linkt Terms and Conditions, and all amounts payable under Your Rental Contract are subject to subsequent verification. 9. Rentals by Privilege Loyalty Program members are subject to the Privilege Loyalty Program Specific Terms. |
